This is an appeal from a decision in an eminent domain case which arose from a Declaration of Taking filed in connection with appellants' land for the purpose of the East Fork flood control project. On July 17, 1972, the government filed the declaration. Appellants and others whose property would be taken for the project unsuccessfully contested the taking on various grounds. The ground upon which this appeal is based concerns the effect of the government's failure to file an appropriate environmental impact statement, see 42 U.S.C. § 4332, until April 15, 1974.
